State law, in every state that I know of, prevents prenups and postnups. There’s certain requirements to make it binding. For example, formalities of signing, the number of witnesses required, and notarizing, and that sort of thing. Also, each party ought to have their own independent counsel. Neither party should be coerced. Both parties should have plenty of time to consider it. Both parties should disclose their assets fully and fairly.
