In probate, to open a probate, you first need to file an initial petition for administration. You need to file a petition to appoint a personal representative. You need to file the death certificate and the original last will and testament or you need to let the court know if there is no last wIll and testament and if the estate is going to be what’s called intestate because there is no last will and testament. Once the court has reviewed all of the pleadings and has appointed a personal representative and signed what’s called letters of administration, then the estate is open. The personal representative is charged with administering the estate through the probate process.
